Salary TDS Return & Form-16
Purpose:
- Used by employers to report the Tax Deducted at Source (TDS) from salary payments made to their employees during a quarter.
- Ensures the timely deposit of TDS to the government and accurate reporting of employee income for tax purposes.
Due Dates:
- Quarterly: Filed for each quarter of the financial year (April-June, July-September, October-December, January-March).
- Due on the 31st of the following month after the end of each quarter (e.g., for Q1, due on July 31st).
Penalties for Late Filing:
- Rs. 200 per day: Late filing fee under Section 234E, charged until the return is filed.
- Additional penalty: Up to Rs. 10,000 under Section 271H, at the discretion of the Assessing Officer.

- Amount of tax deducted at source by your employer
- Taxable income
Importance of Form 16:
- Proof of income: Serves as valid proof of income for various purposes, like applying for loans, visas, or credit cards.
- Accurate tax calculation: Helps you calculate your correct tax liability and claim any eligible tax refunds.
- Filing Income Tax Return (ITR): Essential document for filing your ITR and reporting your income and tax deductions accurately.

Who receives Form 16?
- All salaried individuals whose employers deduct TDS from their salary.
- Individuals receiving pension income where TDS is deducted.
When is Form 16 issued?
- The employer must issue Form 16 on or before June 15th of the following financial year (e.g., for the financial year 2023-24, Form 16 should be issued by June 15th, 2024).
- If the employer fails to issue Form 16 on time, they are liable for a penalty of Rs. 100 per day until the form is issued.
