About Trademark Opposition
Overview
A trademark opposition is filed under Section 21 of the Trade Marks Act, 1999 by any person who objects to a mark advertised in the Trade Marks Journal. The notice of opposition in Form TM-O must be filed within 4 months of advertisement.
If your application is opposed, you must file a counter-statement within 2 months, otherwise the application is treated as abandoned. The case then moves to evidence and hearing before the Registrar.

- Prior use and similarity analysis
- Deadline tracking on IP India
This is a starting fee per stage. The final fee depends on evidence, hearings and complexity.
Monitoring the Journal regularly is the best way to protect your brand in time.
