About Section 8 Company – Incorporation + Compliance
Overview
A Section 8 company is formed under Section 8 of the Companies Act, 2013 for charitable objects such as education, health, social welfare and environment. Profits must be applied only to the objects and cannot be distributed to members.
Company Mitra handles name reservation, MoA and AoA drafting, licence and incorporation through SPICe+.
- No minimum capital
- Licence and incorporation together
- Eligible for 12A and 80G
A Section 8 company is considered more credible than a trust or society by donors, CSR funders and government departments. It can be formed as a private or public company and needs at least two directors for a private company. The licence is obtained along with incorporation in SPICe+, and the name usually ends with Foundation, Association, Council or similar words. After incorporation, we can also help you apply for 12A and 80G registration so that the entity is tax exempt and donors get a deduction. Fee excludes MCA fee and stamp duty.
