RELEASE OF EASEMENT OF RIGHT OF WAY

THIS RELEASE is made at…………….this…………….day of……………between A son of B resident of …………….(hereinafter called “the First Owner”) of the ONE PART and C son of D resident of………….(hereinafter called “the Second Owner) of the OTHER PART

WHEREAS

(1)The first owner is seized and possessed of the piece of land situate at……………. delineated and coloured pink on the plan

(2) The second owner is seized and possessed of the piece of land situate at ….delineated and coloured green on the said plan.

(3) The first owner had granted the right of way to the second owner for the purpose of going to the highway through his land vide Deed dated…………….registered with No . …………….dated…………….with the Office of Sub-Registrar of Assurances, Bombay, hereinafter called the within-written deed

(4) As the second owner has got another way to go to the highway and for the consideration hereinafter mentioned, he has agreed to release unto the first owner the within granted right of way.

NOW THIS DEED WITNESSETH AS FOLLOWS

In consideration of the sum of Rs…………….paid by the first owner to the second owner (the receipt whereof the second owner hereby acknowledges), the second owner as beneficial owner hereby releases and abandons unto the first owner all that right of way granted to him for the purpose of going to the highway through the land of first owner, which was granted by the within-written deed to the first owner to the intent that such right shall henceforth cease and determine
