Subject : Abrogation of purchase order due to non-payment.

Kindly refer to the order dated ……………………. u/s 269UD(1) for purchase of the above property.

My client (i.e. the transferor of the property) has instructed me to submit that the payment in pursuance of the said pre-emptive purchase should have been made to my client u/s 269UG(1) within ……………… in which the said property becomes vested in the Central Government. The said period has already expired. Therefore the said order dated…………..u/s 269UD(1) stands abrogated as per provision of section 269UH(1) .

Under the circumstances, you are requested –

(i) To make a declaration in writing to this effect u/s 269UH(2) and deliver a copy of the said declaration to my client as well as those entitled u/s 269UD(2) at earliest.

(ii) To deliver the possession of the said immovable property to my client u/s 269UH(2)(b)

(iii) To issue a no objection certificate as referred to in section 269UL(1) .
